Terms & Conditions

These terms govern the use of the Pusaka Adil website and, together with our client engagement letters, set out the basis on which we provide legal services. Please read them carefully. If you have any questions, we are glad to discuss them before any engagement begins.

1. About Us

Pusaka Adil is a legal practice registered in Malaysia, operating from Lot 14-3, Jalan Bukit Bintang, 55100 Kuala Lumpur. We specialise in pension protection, EPF entitlement matters, and estate succession planning for retirees and their families.

Our advocates are members of the Malaysian Bar Council. The practice is subject to the Legal Profession Act 1976 and the rules and practice directions of the Malaysian Bar.

The information on this website is provided for general informational purposes. It does not constitute legal advice and does not create a solicitor-client relationship. Legal matters are fact-specific; the information here may not apply to your individual circumstances.

3. Enquiries and Contact Forms

Submitting an enquiry through our contact form does not create a solicitor-client relationship. A relationship is formed only when we have confirmed in writing that we are able to accept your matter and have issued an engagement letter, which you have signed and returned.

Until that point, you should not share confidential information through the website or assume that any information shared is protected by legal professional privilege.

We endeavour to respond to all enquiries within two working days. However, we are a small practice and there may be occasions when responses take a little longer.

4. Our Legal Services

Pension Entitlement Review — RM 350

A careful review of your pension entitlements under Malaysian law, covering KWSP (EPF) records and statutory pension schemes. The engagement includes initial document gathering, a written advisory note, and a follow-up call. The fee is payable in full before the written advisory note is issued.

Pension Dispute Representation — RM 680

Legal representation in relation to pension entitlements that have been refused, reduced, or delayed. This service covers correspondence with relevant bodies and formal complaints where appropriate. Further fees may apply if the matter proceeds to formal proceedings; these will be discussed and agreed with you in advance. The initial fee covers the correspondence and negotiation stage.

Estate and Pension Succession Planning — RM 980

Planning for the orderly transfer of pension benefits and related retirement assets. The service covers nomination arrangements (penama), wills, and where appropriate, hibah or amanah arrangements. The fee covers the initial consultation and preparation of the relevant documents. Disbursements (such as stamp duty or registration fees) are billed separately at cost.

Service Scope and Limitations

Our services are limited to the scope described in the engagement letter for your matter. We will advise you if circumstances arise that fall outside that scope. We do not provide advice on matters of taxation, accounting, or financial planning; you should seek appropriate professional advice for those areas.

5. Fees and Payment

Our fees are as set out above and on our services page. All fees are quoted in Malaysian Ringgit and are inclusive of GST where applicable. Fees are subject to review and any change will be communicated to you before work commences.

Payment is accepted by bank transfer, cheque made payable to Pusaka Adil, or by cash at our office. Receipt will be issued upon payment.

Where a matter does not proceed after the initial consultation through no fault of ours, we reserve the right to charge a reasonable consultation fee for time already spent.

6. Termination of Engagement

You may end our engagement at any time by notifying us in writing. We will render an account for work completed to that point at the agreed rate.

We may decline to continue acting in circumstances permitted under the Legal Profession Act 1976 and the Rules of Professional Conduct, including where a conflict of interest arises, where instructions are inconsistent with our professional obligations, or where fees are not paid in accordance with agreed terms. We will give reasonable notice where possible.

7. Confidentiality and Professional Privilege

Information you share with us in the course of a legal engagement is held in confidence and subject to legal professional privilege. We will not disclose it without your consent, except where required by law, court order, or our professional regulatory obligations.

Our confidentiality obligations continue after an engagement ends.

8. Limitation of Liability

We carry professional indemnity insurance as required by the Malaysian Bar Council. Our liability to you in relation to our legal services is subject to the terms set out in the engagement letter for your matter.

We are not liable for any loss arising from your reliance on the general information published on this website, which does not constitute legal advice. We are not responsible for the content of external websites to which this site may link.

9. Complaints

We take client concerns seriously. If you are dissatisfied with any aspect of our service, please raise the matter in the first instance with the advocate handling your file. If you remain dissatisfied, you may write to us at our office address and we will respond within fourteen days.

10. Governing Law

These terms and any dispute arising from the use of this website or the provision of our services are governed by the laws of Malaysia. Any dispute shall be subject to the jurisdiction of the courts of Malaysia.

11. Intellectual Property

All content on this website — including text, design, and layout — is the property of Pusaka Adil or used under licence. You may print or save extracts from these pages for your personal reference but not for commercial use. Nothing on this site grants any licence to use our name, logo, or branding.

12. Changes to These Terms

We may update these terms from time to time to reflect changes in our practice or in the law. The date at the top of this page indicates when the terms were last revised. Continued use of the website after any changes constitutes acceptance of the revised terms.
